Does Taiwan have birthright citizenship?

No. Taiwanese citizenship is based on descent (jus sanguinis), or naturalization. Children born to foreign national parents in Taiwan are not Taiwanese citizens and will follow the procedures of the parent’s nationality. Exceptions apply if both parents are stateless.

However, being born in Taiwan affords certain benefits during naturalization. For example:

  • Able to apply for naturalization after 3 consecutive years resident for 183 days (normally 5 years) [Nationality Act Art 4]
  • Able to apply for naturalization if mother/father was also born in Taiwan (no residence requirement) [Nationality Act Art 5
